Terms of Service

1. Who we are

These terms are an agreement between you and Memory Rolls LLC, a Minnesota limited liability company ("Memory Rolls", "we", "us"). They cover memoryrolls.com, event-camera.memoryrolls.com, host-branded addresses we serve for hosts, and the Event Camera service (together, the "Service"). By using the Service you agree to these terms and to our Privacy Policy.

2. Who can use the Service

You must be at least 18 to create a host account or to buy seats. Guests under 18 may take part in an event only with the permission of a parent or guardian and of the host. The Service is not directed at children under 13.

A host creates an event, sets how many guests can join and how many shots each guest gets, invites guests, and curates and shares the album. As a host you agree that:

4. Guests

To join an event, a guest gives a first name and an email address. Each guest gets a set number of shots. Guests can't see, retake or delete their shots during the event; the host decides which shots go in the album. Guests receive the album by email or link if the host shares it.

5. Seats, prices and payment

Prices are in US dollars and may change for future purchases; a change never affects seats already bought. Applicable taxes may be added at checkout. Payments are processed by Stripe; we don't receive or store full card numbers. A seat is for one event and can't be moved to another event. Seats are not refunded once bought, whether or not they're used, except as described in our Refund Policy.

6. Your content

You keep ownership of the photos and videos you take ("Content"). By uploading Content to an event, you give Memory Rolls a limited, non-exclusive, royalty-free licence to store, process (for example, to make smaller preview copies) and display it, only to run the Service; and you give the event's host permission to view, curate, download and share your Content in that event's album and with that event's guests. We don't use your Content for advertising and we don't sell it.

You promise that you have the right to upload your Content, and that it doesn't break the law or anyone's rights.

7. What's not allowed

Don't use the Service to upload or share anything illegal; sexual content involving anyone under 18; content that harasses, threatens or exposes someone, or that invades their privacy (for example, intimate images shared without consent); or content that infringes someone else's rights. Don't try to get around shot or seat limits, access other events or accounts, disrupt the Service, or use it to send spam. We may remove Content, close events and suspend accounts that break these rules, and may report illegal content to the authorities.

8. Storage and deletion

Photos and videos are kept for 90 days after the event ends, and then deleted along with their preview copies. The album link stops working at that point. Hosts can delete an event at any time, which permanently deletes its photos, videos, guest list, invites, album and guest codes. Deleted Content can't be recovered. The Service isn't a backup or archive: please download anything you want to keep.

9. Emails

We send invitations and albums on a host's behalf, and messages about your account and payments. Every invitation and album email has an unsubscribe link. Once you unsubscribe, we won't send you invitations or albums from any host.

10. Availability and changes

We work to keep the Service available and your Content safe, but we can't promise it will be uninterrupted or error-free, and phone cameras, browsers and networks are outside our control. We may change or discontinue features. If we discontinue the Service, we'll give hosts reasonable notice and a chance to download their Content.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the fullest extent the law allows, Memory Rolls will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data or Content, lost profits or lost memories, arising from the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the event the claim relates to, or $50. Some jurisdictions don't allow some of these limits, so they may not all apply to you.

13. Indemnity

If you're a host, you agree to defend and indemnify Memory Rolls against claims arising from your event, the Content shared through it, or your breach of these terms.

14. Ending your use

You can stop using the Service at any time. Hosts can delete their events; to close a host account, email us. We may suspend or end access for anyone who breaks these terms.

15. Governing law

These terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Any dispute will be decided in the state or federal courts located in Minnesota, and you and we agree to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally.

16. Changes to these terms

We may update these terms. We'll post the new version here with a new effective date, and tell hosts by email or in the host portal about material changes. Continuing to use the Service after a change means you accept it.
